Terms of Use

Last updated: October 19, 2026

These Terms and Conditions ("Terms") apply to your use of the CreativeMachine™ website and to the CreativeMachine program, including discovery calls, the two-day in-person workshop and the six months of ongoing support. CreativeMachine is operated by [Legal entity name, e.g. Defiant Digital Pty Ltd] (ABN [00 000 000 000]) of Sydney, New South Wales ("CreativeMachine", "we", "us", "our").

By using our website, booking a call or purchasing the program, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you have authority to bind that business, and "you" includes that business. If there is any conflict between these Terms and a signed proposal or order form, the proposal or order form applies.

1. The program

CreativeMachine is a creative-strategy education and implementation program for businesses already running paid advertising. Unless your proposal says otherwise, it includes:

  • Two-day in-person workshop at our Sydney HQ with our senior creative strategists, covering research, creative angles, briefs, product and founder content capture, a first batch of ads, testing frameworks, team planning and SOPs;

  • Six months of support starting from the first day of your workshop, including one live group support call each business day (Monday to Friday, excluding NSW public holidays and our end-of-year shutdown) and access to our private community on Skool;

  • Templates and materials, including your CreativeMachine master strategy sheet.

The exact deliverables, dates, number of attendees and price will be set out in your proposal, invoice or booking confirmation. We may update the content, format, presenters or tools used in the program from time to time, as long as the overall value is not materially reduced.

CreativeMachine is education, strategy and support. It is not a done-for-you agency service. Unless agreed in writing, we do not manage your ad accounts, spend your ad budget or run your campaigns.

2. Discovery calls and eligibility

Discovery calls are free and do not create any obligation for either party. We may decline to offer the program to any business at our discretion, for example if we do not believe it is the right fit.

3. Fees and payment

  • Fees are as stated in your proposal or invoice and are in Australian dollars (AUD). Unless stated otherwise, prices include GST where applicable.

  • Your workshop date is confirmed once we receive payment in full, or the deposit stated in your proposal.

  • If you are on a payment plan, instalments must be paid on time. If a payment is more than 7 days overdue, we may pause your access to support calls and the community until it is paid.

  • You are responsible for your own travel, accommodation and incidental costs to attend the workshop in Sydney, and for your own advertising spend, software subscriptions, creator fees and production costs.

4. Rescheduling

You may reschedule your workshop once, free of charge, by giving us at least [14] days' written notice before the workshop start date, subject to availability. Requests with less notice may incur a rescheduling fee of [AUD amount] or may not be possible.

If we need to reschedule due to illness, emergency or circumstances outside our control, we will give you as much notice as we can and offer a new date. If no suitable alternative date can be agreed, we will refund amounts paid for the workshop portion that has not been delivered.

We are not responsible for travel or accommodation costs you incur if a workshop is rescheduled, so we recommend booking flexible fares or travel insurance.

5. Cancellations and refunds

  • More than [30] days before your workshop: you may cancel by written notice and receive a refund of amounts paid, less a non-refundable deposit of [AUD amount / %].

  • [30] days or less before your workshop: fees are non-refundable, but you may reschedule once (see section 4) or transfer your place to another person in your business.

  • After the workshop starts: fees are non-refundable, including for any unused support period.

Nothing in these Terms limits your rights under the Australian Consumer Law. If a guarantee under that law applies and we fail to meet it, you may be entitled to a remedy such as a refund or re-supply of services.

6. Your responsibilities

To get the most from the program, you agree to:

  • give us accurate information and timely access to the materials we reasonably need, such as ad account access, customer research, brand assets and products for the studio;

  • attend scheduled sessions on time and complete any pre-workshop tasks;

  • make sure you own or have permission to use any content, trademarks, images, product claims or customer data you provide to us;

  • make sure your ads comply with all laws and platform policies, including the Australian Consumer Law and Meta, Google and TikTok advertising rules;

  • behave respectfully toward our team, other participants and community members;

  • follow reasonable safety and conduct rules at our HQ and studio.

You remain responsible for all decisions about your business, including what you publish, how much you spend and who you hire.

7. Live calls and community

Support calls and the Skool community are shared spaces with other businesses. Please do not share confidential information you are not comfortable others seeing. You must not record, copy, resell or share call content or community posts outside the program without our permission. Support calls may be recorded by us for program and training purposes. We may remove posts or suspend access for anyone who is abusive, spams, promotes their own services without permission or breaches these Terms. Access to calls and the community ends when your six-month support period ends, unless you purchase an extension.

8. Intellectual property

Your materials. You keep ownership of everything you bring to the program, including your brand, products, customer data and existing creative. You give us a licence to use these materials only to deliver the program to you.

Your deliverables. Once you have paid in full, you own the business-specific outputs created for you during the program, such as your briefs, creative angles, hook bank, ads, founder clips, product shots and completed strategy sheet. You may use them in your business without further payment to us.

Our materials. We keep all rights in our methods, frameworks, templates, SOPs, training content, recordings and the CreativeMachine™ name and brand ("Our Materials"). We give you a non-exclusive, non-transferable licence to use Our Materials internally within your own business. You must not resell, publish, share with third parties or use Our Materials to run a competing program or training service.

AI-generated content. Some deliverables may be created with the help of AI tools. Ownership and copyright protection for AI-assisted content can be uncertain, and outputs may resemble content generated for others. You are responsible for reviewing all content before publishing it.

Portfolio use. With your consent, we may reference your business name, logo, results or testimonial in our marketing. See our Privacy Policy for more detail.

9. Confidentiality

Each party will keep the other's confidential information private and use it only for the program. This does not apply to information that is already public, was already known to the receiving party, or must be disclosed by law. Our team will treat your ad account data, performance figures and business plans as confidential.

10. No guarantee of results

Advertising performance depends on many factors outside our control, including your product, offer, pricing, budget, market, competition, platform changes and how you implement what you learn. We do not guarantee any particular outcome, such as sales, revenue, leads, ROAS, CPA or CPL. Case studies, testimonials and figures on our website reflect individual experiences and are not a promise of future performance.

11. General

  • These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the courts of New South Wales.

  • If any part of these Terms is found invalid, the rest continues to apply.

  • If we do not enforce a right straight away, we have not waived it.

  • You may not transfer your rights under these Terms without our written consent.

  • We may update these Terms from time to time. Changes apply to purchases made after the update; the version in place when you booked applies to your program.

  • These Terms, together with your proposal or invoice, are the entire agreement between us about the program.
